A dental technician was sentenced for committing a crime of professional intrusion
Criminal Court No. 5 of Donostia-San Sebastián has sentenced a dental technician for committing a crime of professional intrusion when performing functions typical of dentists.

According to the ruling, despite lacking the necessary official qualification to do so, the dental technician attended to a patient in his laboratory on four occasions who required a skeleton (removable partial prosthesis). During these visits, he took measurements, made the prosthesis, adapted it and placed it in the patient's mouth "with the dentist being the one who legally has to take the necessary impressions of the patient's mouth and indicate in writing and accompanied by three-dimensional elements how the prosthesis that the dental technician must make should be, following the dentist's instructions," the judge details.

Since the facts constitute a crime of professional intrusion, as defined in article 403.1 of the Criminal Code, the judge has sentenced the dental technician to a fine of 12 months at the rate of 6 euros per day (€2160) and to pay the costs, including those of the private prosecution. The sentence is final.

The president of the General Council of Dentists, Dr. Óscar Castro Reino, congratulates the College of Dentists of Guipúzcoa for the legal actions they have taken and calls for tougher penalties for professional intrusion crimes so that they are truly dissuasive. “The fines are frankly ridiculous for such a serious crime, since these actions can cause irreparable damage to people's health,” concludes Dr. Castro.
